Focus Cosmo Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Focus Cosmo (the “App”), you agree to these Terms of Service (“Terms”). If you do not agree, please do not use the App. These Terms form a legally binding agreement between you and Focus Cosmo.

2. Description of Service

Focus Cosmo is a focus and productivity app inspired by the Pomodoro method. The App offers:

• Customizable focus sessions (Pomodoro and flexible timers)
• Focus music and ambient sounds
• Cosmic themes and visual customization
• Progress tracking and basic statistics
• Free (Explorer) and Premium subscription tiers

3. Eligibility

Focus Cosmo is not directed to children under 13 (or the higher digital consent age in your country). By using the App, you confirm that you meet this requirement or have parental consent where required.

4. Accounts

The App does not create or manage user accounts. Subscriptions and purchases are tied to your Apple App Store account. You are responsible for maintaining the security of your Apple account credentials and device.

5. Subscriptions and Payments

5.1 Free Plan (Explorer)

The free Explorer plan includes limited features: up to 3 sessions/day or 1 Pomodoro/day, limited themes and planets, and basic sounds.

5.2 Premium Subscription

Premium unlocks unlimited sessions, all themes and planets, all sounds, and full customization. Subscriptions are available monthly or annually. Pricing and availability may change and will be displayed in-app before purchase.

5.3 Payment & Renewal

• Payments are processed by Apple’s App Store.
• Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period.
• Your Apple account will be charged within 24 hours before renewal.
• Manage or cancel subscriptions from your Apple account settings.

5.4 Refunds

Refunds must be requested through Apple. We cannot process refunds directly. Apple’s refund policies apply. See App Store guidelines for details.

If obtained via the Apple App Store, your purchase and use are also governed by Apple’s Licensed Application End User License Agreement (EULA). Where there is a conflict, the App Store EULA may apply to the extent required by Apple.

6. Third-Party Services

The App may integrate third-party services (e.g., RevenueCat for subscription status). Your use of those services may be subject to their own terms and privacy policies. We are not responsible for third-party services and do not control their data practices.

7. Intellectual Property

All content and functionality of Focus Cosmo—including text, graphics, logos, icons, images, audio, and software— are the property of Focus Cosmo and protected by intellectual property laws. You may not copy, modify, distribute, or exploit any part of the App without our prior written consent.

8. Acceptable Use

You agree not to misuse the App. Prohibited actions include:

• Using the App in violation of laws or regulations
• Reverse engineering, decompiling, or tampering with the App
• Uploading or transmitting harmful code or malware
• Interfering with or disrupting App functionality
• Attempting unauthorized access to systems or services

9. Disclaimer of Warranties

The App is provided “as is” and “as available” without warranties of any kind. We do not guarantee uninterrupted operation, accuracy of results, or error correction.

10. Health Disclaimer

Focus Cosmo is a productivity tool. It is not a medical device and does not provide health or medical advice. If you have health concerns, consult a qualified healthcare professional.

11. Limitation of Liability

To the extent permitted by law, we are not liable for:

• Indirect, incidental, special, or consequential damages
• Loss of profits, data, or goodwill
• Unauthorized access, bugs, or malware transmitted via the App

In any case, our aggregate liability for all claims relating to the App will not exceed the greater of (a) the total amount you paid in the 12 months before the claim, or (b) the minimum amount required by applicable law.

12. Indemnification

You agree to indemnify and hold harmless Focus Cosmo and its affiliates from claims or damages arising from your use of the App or violation of these Terms.

13. Governing Law

These Terms are governed by the laws applicable in your country of residence. If mandatory local consumer protection laws apply in your jurisdiction, those protections remain unaffected.

14. Export & Sanctions Compliance

You represent that you are not located in, under the control of, or a national or resident of any country or person subject to embargoes or sanctions, and you agree to comply with applicable export laws and regulations.

15. Changes to Terms

We may update these Terms from time to time. Changes will be posted here with a revised “Last updated” date. Continued use of the App after changes constitutes acceptance.

16. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, form the entire agreement between you and Focus Cosmo regarding use of the App.

18. App Store Terms

If you obtained the App via the Apple App Store, your use is also subject to Apple’s App Store Terms and the Licensed Application End User License Agreement (EULA). Apple is not responsible for providing maintenance or support for the App.
