Habitorm Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Habitorm mobile application and website (collectively, the “App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the App. Our Privacy Policy is incorporated by reference.

2. Description of Service

Habitorm helps you build and maintain habits with features such as custom habit creation, reminders, progress stats, streaks/levels/points, a personal dashboard, and an optional leaderboard visible to authenticated users.

• Custom habit creation and tracking
• Progress statistics and analytics visible only to you
• Push notification reminders (if enabled)
• Gamification elements (points, streaks, levels)
• Optional leaderboard visibility for display name, level, points, and streak

3. Eligibility

You must be at least 13 years old to use the App. If you are in a jurisdiction where a higher digital consent age applies (e.g., some EEA/UK countries), you must meet that age or have parental consent.

4. Accounts & Deletion

Account

You can create an account either (a) with your email and password, or (b) using Sign in with Apple. When you use Sign in with Apple, we do not receive your Apple password; Apple provides us with an identifier and, if you allow, an email address (which may be a private relay address). If you use Apple’s “Hide My Email”, you are responsible for maintaining access to your Apple ID and the relay.

Display name. We assign a default display name (e.g., “Challenger123”) at sign-up. You can change your display name at any time in the App settings. Your display name may be visible to other authenticated users on the leaderboard. You agree not to use names that are unlawful, infringing, misleading, or that impersonate others; we may remove or modify display names that violate these Terms.

Security. You are responsible for safeguarding your account credentials and devices, including any third-party SSO accounts, and for activity under your account. Notify us promptly of any unauthorized use. You must not share your account or permit others to access it. We may reclaim or disable usernames that are inactive or violate policy.

Deletion

You can delete your account in-app at any time. We promptly delete or anonymize active records. Certain data may persist in encrypted backups for up to 90 days, after which it is purged in the normal course of business. We may retain minimal records where legally required (e.g., security or fraud prevention). Deletion is permanent and cannot be undone.

5. License & Acceptable Use

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes in accordance with these Terms.

You agree not to:

• Violate laws or third-party rights
• Reverse engineer or attempt to extract source code where prohibited
• Circumvent security or access controls
• Upload malicious code or interfere with the App
• Commercially exploit, resell, rent, or sublicense the App without our consent

6. User Content & Feedback

You retain ownership of the data you submit. You grant us a worldwide, non-exclusive, royalty-free license to host, process, and display your content only as necessary to operate and improve the App, provide support, security and backups.

If you provide feedback or suggestions, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use them without restriction or compensation.

7. Leaderboard Visibility

If you participate in the leaderboard, your display name, level, points, and longest streak are visible to other authenticated users. Your email is never displayed. If we add visibility controls in the future, they will be available in settings.

8. Subscriptions & Payments

We may offer Weekly and Yearly subscriptions. Pricing and local taxes will be displayed in-app before purchase. If offered, free trials or introductory offers will be shown in-app.

• Auto-Renewal: Subscriptions renew automatically unless cancelled at least 24 hours before the current period ends.
• Billing: Your platform account (e.g., Apple App Store / Google Play) will be charged. Manage or cancel from your device account settings.
• Changes: We may update prices; we will notify you in-app or via the platform. Continued use after the change takes effect constitutes acceptance.
• Refunds: Subject to local law and platform rules; you may need to request refunds directly from the platform provider.

If you obtained the App from the Apple App Store, your purchase and use are also governed by Apple’s Licensed Application End User License Agreement (EULA). In case of conflict, the App Store EULA may apply to the extent required by Apple.

Subscriptions are managed via RevenueCat, which communicates securely with Apple’s App Store to verify and maintain your subscription status. We do not process or store payment details. All payments and renewals occur through your Apple ID account. Refund requests must be submitted directly to Apple under their App Store policies.

9. Intellectual Property

The App and its original content, features, and functionality are owned by Habitorm and protected by applicable intellectual property laws. All rights not expressly granted are reserved.

10. Service Availability; Beta

We strive for high availability but the App is provided “as is” and “as available”. Certain features may be offered as beta or experimental and may change or be discontinued at any time.

11. Third-Party Services

We may integrate third-party services (e.g., authentication, push notifications). Your use of such services may be subject to their terms and privacy policies.

12. Disclaimer; Limitation of Liability

Disclaimer. THE APP IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND.

Health & Wellness. Habitorm is a productivity tool and not medical or health advice. Consult a professional for health-related concerns.

Limitation. To the maximum extent permitted by law, our aggregate liability for all claims related to the App shall not exceed the greater of (a) amounts you paid to us in the 12 months before the claim; or (b) USD 50. Some jurisdictions do not allow certain limitations—your rights may vary.

13. Indemnity

You agree to defend, indemnify, and hold harmless Habitorm and its affiliates from claims arising out of your misuse of the App or violation of these Terms.

14. Termination

We may suspend or terminate your access for material breach or unlawful use. Upon termination, your license ends and provisions that by their nature should survive (e.g., ownership, disclaimers, liability limits, governing law) will survive.

15. Governing Law & Venue

These Terms are governed by the laws of Türkiye (without regard to conflicts principles). The courts of İstanbul have exclusive jurisdiction. If you are a consumer and mandatory local law grants you protective rights, those rights remain unaffected.

16. Export & Sanctions Compliance

You represent that you are not located in, under the control of, or a national or resident of any country or person subject to embargoes or sanctions and you will comply with applicable export laws.

17. Changes to Terms

We may modify these Terms. We will post updates here and update the “Last updated” date. For material changes, we may provide additional in-app notice. Your continued use after changes take effect constitutes acceptance.
